Privacy Notice

This Privacy Notice describes how ALCHEMA, Inc. (“ALCHEMA”, “we”, “our”, or “us”) collect, use and disclose your personal information.  This Privacy Notice is subject to change and may be updated from time to time.  We will post any new version on our website, so please read this Privacy Notice and check for any revision.  Any revised notice will supersede and replace the previous Privacy Notice effective as of the date of its posting.  Your continued use of ALCHEMA-branded products, our website, tools, applications, forums and/or services represents and confirms your consent and agreement to such revision.  

 

Information We Collect

We collect your personal information.  Personal information refers to any information that can be linked to your identity, such as your username, profile picture and email address.

Because many of our products and services are accessible only after you register, we will ask you to provide a username and password when you register.  In addition, we may collect some or all of the following types of personal information (non-exhaustive list for illustration purposes) from you, based on the products or services you select:

  1. Your name, title and contact information, such as your postal/physical address, mailing address, contact preferences, telephone number and email address;
  2. Your birth date, gender, occupation, industry and employer;  

iii.      Other information you provide, including information you provide about other people (e.g. when you send gift certificates and products or invite others to access ALCHEMA products, tools, applications, services or forums);

  1. Your real-time location, your device’s Internet Protocol (IP) address or unique device identifier (UDI), sign-on data, page view statistics, website traffic and other personal website preferences.

If you choose not to provide the personal information we requested, in many cases we may be unable to provide you with our products or services or respond to your inquiries.

 

Methods of Collecting Your Information

Most of the personal information we collect is obtained directly from you online, through our software applications, or whenever you contact us; for example, when you purchase a product, register for access of our services/tools/applications/forums, download software updates, contact us, or participate in online surveys.  We may also collect personal information off-line in connection with our providing products or services, such as through our customer service call centers, at in-person events, and through postal mails.  We may obtain your personal information from other sources such as third parties we engage to perform administrative or other services; for example, when they provide us with a delivery confirmation or report problem with your purchase.  We may use tracking technologies such as cookies (small files placed on your hard drive), web beacons (electronic images placed in the web page code) and website analytics tools (tools that collect information sent by your browser or mobile device) on your device when you access our website, services, applications, tools and/or forums.  These tracking technologies can help us customize your online experience and improve our website, applications, tools, forums and services; we may use this data and may compile and analyze the data to improve our products and services.  By accessing our website, services, applications, tools and/or forums, you consent to the placement of cookies and the use of tracking technologies.  While you can block our cookies by changing the settings on your browser, doing so may prevent your access to our services, applications, tools and/or forums.

 

Why We Collect Your Personal Information and Its Uses

The collection and use of your personal information may be necessary in order for us to provide you with products or services, contact you regarding your purchase and delivery, keep you posted on our latest product announcements, software update and events, communicate with you and maintain relationship with you.  If you do not provide us with your personal information, we may be unable to provide these things to you.

We disclose your personal information for the purposes for which we collect it, that is, to enable you to access our website/applications/tools/forums, to improve their operation and to provide our products and services to you.  We may share your personal information with our authorized third parties (i.e., our affiliates, vendors, consultants and contractors) whom we engage to perform administrative or other services, such as helping with our business operations and the storage and processing of personal data.  Our authorized third parties will be given limited access to your information as is reasonably necessary to deliver the product or service, and we will require such third parties to comply with this Privacy Notice, or operate under a similar privacy policy. 

We do not knowingly disclose personal information to third parties for their marketing purposes without your consent.  We only knowingly share personal information with non-affiliated third parties (i.e., parties other than ALCHEMA or its affiliates) for their own marketing purposes if you specifically opt-in, or are offered the opportunity to opt-out and elect not to opt-out.

We may use the information we collect or receive, such as your email address, to communicate directly with you.  We may send you emails containing newsletters, product announcements, promotions, and special offers.  If you do not want to receive such offers and information from us, our affiliates and our related companies, you are not obliged to receive them and have the option to opt out at any time or change your preferences.  We also use your information to send you service-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of our services, software updates, product recalls, safety alerts, technical and security notices); but you may not opt out of such service-related emails.

We may disclose your personal information if you give us your consent or if the disclosure is required to comply with applicable laws, legal processes, reasonable request of law enforcement, to exercise our legal rights or defend against legal claims.  We may disclose personal information and other information available to us when we believe, in our discretion, the disclosure is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to us or the rights, property or safety of any person, breaches of our Terms of Use or other agreements, or as otherwise required or permitted by law.  We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of ALCHEMA.  For example, if ALCHEMA undergoes re-organization, merger or sale of all or a part of its assets, we may transfer your personal information as part of the transaction.

We may share certain service type information, including information obtained through tools such as cookies, log files, device identifiers, location data and web beacons, analytic tools and other tracking technologies with our authorized or non-affiliated third parties for the purposes described above.  We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties.

Request Deletion of that data

If you're having issues with ALCHEMA, try the following troubleshooting tips:
• Close all running apps.
• Restart ALCHEMA and your device.
• Update ALCHEMA to the latest version.
 
If you experience network errors or images do not appear properly, try the following:
• Delete any unnecessary apps and data, and clear the cache on your device.
• Check if your network connection has any restrictions or filtering services in place.
• Clear the ALCHEMA app's cache.
• Offload the app.

Security, Storage and Processing

We may hold personal information in both hard copy and electronic forms in secure databases accessible only to our authorized personnel and third parties.  We take reasonable steps (such as requesting a unique password) to verify your identity before granting access to your account and to ensure that the personal information we hold is protected against misuse, loss, and unauthorized access or disclosure.  However, you are responsible for maintaining the secrecy of your password and account information, and for controlling access to your email communications at all times.  Please take precautions to protect your personal information when you are online.  For example, create strong passwords by using a combination of letters and numbers, change passwords often, and use a secure browser.

Your information collected through our website, services, products, tools, applications, forums, etc. may be stored and processed in the United States or any other country in which ALCHEMA or its parent, subsidiaries, affiliates, or service providers maintain facilities.  We may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders, and from your country or jurisdiction to other countries or jurisdictions around the world.  If you are using ALCHEMA website, services, products, tools, applications, forums, etc. from outsides the United States with laws governing data collection and use that may differ from the U.S. law, please note we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction; and you consent to the transfer and processing of your personal information outside your country of residence, such as to the U.S. or any other country in which ALCHEMA or its parent, subsidiaries, affiliates, or service providers maintain facilities, and the use and disclosure of your information as described in this Privacy Notice.

In the event that any information under our control is compromised as a result of a breach of security, ALCHEMA will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and the proper authorities (if required by law), and take other steps, in accordance with applicable laws and regulations.

 

Your Choices

You have a right to access or change the personal information we collect and hold about you by contacting us at our postal address; we reserve the right to charge you a fee necessary to cover our costs for the retrieval and supply of that information.  There may be some circumstances where we cannot change or delete the information we hold about you.  You control your account information and settings: you may update your account information and email-communication preferences at any time by logging in to your account and changing your profile settings.  You can also stop receiving promotional email communications from us by modifying your preferences.  However, you may not opt out of service-related communications e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of our services, software updates, product recalls, safety alerts, technical and security notices.

 

Children’s Privacy

ALCHEMA products, services, tools, applications, forums, website and its content are intended for adults and not directed to minors.  ALCHEMA does not knowingly collect or solicit any information from minors or knowingly allow such minors to register as its users.  In the event that we learn that we have collected personal information from a minor without proof of parental or guardian consent, we will delete that information to the extent required by applicable law.

 

Retention of Personal Information

ALCHEMA will not retain your personal information longer than is necessary to honor your choices, fulfill the purposes for which it was collected, or as required by law.  However, following termination of your user account, ALCHEMA may retain your personal information for a commercially reasonable time for backup, archival, or audit purposes.

 

Links to Third-Party Websites and Services

We are not responsible for the practices employed by third party websites or services linked to or from our website, products, services, applications, tools and forums.  These linked sites are not under our control and we are not responsible for the privacy practices or the content of such third-party services.  For instance, we do not receive your financial information.  When you enter payment details online, these do not come to us but go directly to an independent third party payment facility such as PayPal.  All such third-party services providers such as PayPal are outside of our control and are not covered by our Privacy Notice.  If you have questions about how these third parties collect, use and share your information, you should consult their respective privacy policies or contact them directly for more information.  By allowing a link to a third-party product or service, or otherwise allowing association with our website, products, services, applications, tools and forums, we are not in any way endorsing, promoting or representing the quality of that third party product or service or taking responsibility for its practices.
